Terms of Use

These terms govern your use of the Safe Workplace website, including our guides, blog and free CQC tools. Please read them before using the site. If you do not agree to them, please do not use the site.

1.Who we are and how to contact us

1.1 safework.place is a site operated by Safe Space Technology Limited (“we”, “us”, “our”), a company registered in England and Wales under company number 12678933, with its registered office at Broadwalk House, Southernhay West, Exeter, Devon, EX1 1TS. Our VAT number is GB420024759.

1.2 We trade as Safe Workplace and provide the CompliantCare and CalmER products.

2.What these terms cover — and what they do not

2.1 These terms cover your use of this website: the pages, guides, blog articles, tools and downloadable files published on it.

2.2 These terms do not govern your use of the Safe Workplace platform. If your organisation is a customer, the supply of the hosted services, training and support is governed by the customer terms and conditions incorporated into your Sales Order, together with the applicable data processing agreement and service level agreements. Those terms take precedence over these ones in respect of the platform. If you would like a copy of them before contracting, ask us and we will send them.

2.3 By using this site you confirm that you accept these terms and agree to comply with them.

2.4 We also publish an Acceptable Use Policy and a Privacy Policy, both of which apply to your use of the site.

3.Changes to these terms and to the site

3.1 We may amend these terms at any time by revising this page. The date at the top shows when they were last updated. Please check this page from time to time.

3.2 We may update or change the site at any time to reflect changes to our products, our users’ needs, or applicable regulation. Regulatory guidance changes, and our content changes with it.

3.3 We do not guarantee that the site, or any content on it, will be free from errors or omissions.

4.Our content and your use of it

4.1 We are the owner or the licensee of all intellectual property rights in this site and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

4.2 You may print off one copy, and download extracts, of any page for your own internal use, and you may draw the attention of others within your organisation to content on the site.

4.3 You must not modify the copies you have made in any way, and you must not use any illustrations, photographs, video, audio or graphics separately from the accompanying text.

4.4 Our status as the author of content on the site must always be acknowledged.

4.5 You must not use any part of the content on the site for commercial purposes without a licence from us. Quoting a short extract with a link back to the source page is welcome and does not require permission.

4.6 “Safe Workplace”, “CompliantCare” and “CalmER” are our trade marks. Other product and company names on this site may be the trade marks of their respective owners, and their use does not imply any affiliation with or endorsement by them.

5.Free tools, templates and downloads

5.1 We publish free resources, including the CQC quality statements crosswalk tool and the care home audit tool, and downloadable spreadsheet and PDF versions of them.

5.2 We grant you a non-exclusive, revocable licence to download, print and adapt these resources for use within your own organisation, including completing them as working documents and retaining the completed versions as part of your own records.

5.3 You may not resell, sub-license, republish or redistribute these resources, or any adaptation of them, whether on their own or as part of a paid or free service to third parties. If you are a consultant and want to use them with clients, contact us — we will usually say yes, and we would rather you asked.

5.4 Where a resource maps our own interpretation onto a regulator’s published framework, we say so on the resource itself. The mapping is our editorial work, not the regulator’s, and section 6 applies to it in full.

5.5 These resources are provided free of charge and “as is”. We give no warranty that any resource is complete, current, or suitable for your particular service, and we accept no liability arising from your use of one. Section 12 applies.

6.Our guidance is not regulatory, legal or professional advice

6.1 The content on this site is published for general information only. It is not regulatory, legal, clinical, employment or other professional advice, and you must not rely on it as such.

6.2 Regulatory frameworks, statutory guidance and inspection methodology change, sometimes at short notice. While we work from primary sources and update our material, we cannot guarantee that any page reflects the position as at the date you read it.

6.3 The regulator’s own published guidance always prevails over ours. Where anything on this site differs from what the Care Quality Commission, or any other regulator or statutory body, has published, theirs is correct and ours should be disregarded.

6.4 Nothing on this site, and no use of any of our free tools, guarantees or is intended to predict any regulatory outcome, inspection rating, registration decision or enforcement result. Those decisions are made by the regulator on the evidence before it.

6.5 You remain responsible for your own regulatory compliance and for the professional judgements you make. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of content on this site.

7.We are not affiliated with the Care Quality Commission

7.1 Safe Space Technology Limited is an independent software company. We are not affiliated with, endorsed by, accredited by, partnered with or otherwise connected to the Care Quality Commission (CQC), NHS England, the Department of Health and Social Care, or any other regulator or government body.

7.2 References on this site to the CQC, to its assessment frameworks, quality statements, key questions, regulations or ratings are references to publicly available material published by the CQC, used for the purpose of explaining and commenting on it. “Care Quality Commission” and “CQC” are used to identify that body and its publications.

7.3 Any commentary, mapping, interpretation, checklist or opinion we publish alongside that material is our own, and is not approved by, issued by or attributable to the CQC.

7.4 The CQC publishes its own guidance at cqc.org.uk, and providers should treat that as the authoritative source.

8.Acceptable use

8.1 You may use this site only for lawful purposes. You must not use it in any way that breaches any applicable law or regulation, is fraudulent or has a fraudulent effect, or is intended to harm any person.

8.2 You must not attempt to gain unauthorised access to the site, the server on which it is stored, or any server, computer or database connected to it; introduce any material that is malicious or technologically harmful; or attack the site via a denial-of-service attack.

8.3 You must not conduct, or ask any other person to conduct, any load testing, vulnerability scanning or penetration testing against this site or our platform without our prior written consent. If you believe you have found a security issue, please tell us at legal@safework.place rather than testing further.

8.4 Our full Acceptable Use Policy forms part of these terms.

9.Accounts and access to the platform

9.1 Access to the Safe Workplace platform is provided to customer organisations under a separate contract. If you are given access credentials as a user within a customer organisation, those credentials are personal to you.

9.2 You must treat your credentials as confidential and must not disclose them to any third party. You must notify us promptly at legal@safework.place if you know or suspect that anyone other than you knows them.

9.3 We may disable any credentials at any time if in our reasonable opinion you have failed to comply with these terms or with the applicable customer terms.

10.Linking to us, and links to other sites

10.1 You may link to any page on this site, provided you do so in a way that is fair and legal, does not damage our reputation or take advantage of it, and does not suggest any form of association, approval or endorsement on our part where none exists.

10.2 You must not establish a link in any website that is not owned by you, and you must not frame this site on any other site.

10.3 Where this site contains links to other sites and resources provided by third parties, including regulators and statutory bodies, those links are provided for your information only. We have no control over the contents of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

11.Availability of the site

11.1 We do not guarantee that this site, or any content on it, will always be available or uninterrupted. We may suspend, withdraw or restrict the availability of all or any part of it for business and operational reasons.

11.2 You are responsible for making all arrangements necessary for you to have access to the site, and for ensuring that all persons who access the site through your internet connection are aware of these terms and comply with them.

12.Our liability to you

12.1 Nothing in these terms excludes or limits our liability for death or personal injury arising from our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law.

12.2 We exclude all implied conditions, warranties, representations and other terms that may apply to this site or any content on it, to the fullest extent permitted by law.

12.3 We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, arising under or in connection with your use of, or inability to use, this site, or your use of or reliance on any content on it or on any free tool or download.

12.4 In particular, and without limiting section 12.3, we will not be liable for loss of profits, sales, business or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; any regulatory outcome, rating, enforcement action or registration decision; or any indirect or consequential loss or damage.

12.5 If you are a consumer rather than a business user, nothing in this section affects your statutory rights. Different limits and exclusions apply to liability arising under a customer contract for the platform, which are set out in that contract.

13.Your personal data

13.1 We only use your personal data as set out in our Privacy Policy, which explains what we collect, why, how long we keep it, and the rights you have over it.

13.2 Where we act as a processor of personal data on behalf of a customer organisation, that processing is governed by the data processing agreement with that organisation rather than by these terms.

14.Uploads, enquiries and material you send us

14.1 If you send us material through the site — an enquiry, a demo request, a download form or otherwise — you confirm that it is accurate, that it is yours to send, and that sending it does not breach any obligation you owe to anyone else.

14.2 Please do not send us personal data about service users, patients, employees or any other individual through this website. Our web forms are not an appropriate channel for special category or safeguarding information. If you need to share that kind of material with us, contact us first and we will arrange a secure route.

14.3 Any material you send us that is not personal data will be treated as non-confidential unless we agree otherwise in writing, and we may use it to respond to you and to improve our services.

15.Governing law

15.1 These terms, their subject matter and their formation are governed by the law of England and Wales.

15.2 We and you both agree that the courts of England and Wales will have exclusive jurisdiction, except that if you are a consumer resident in another part of the United Kingdom, you may also bring proceedings in that part.
